PHOENIX — Gov. Jan Brewer was quick to denounce a federal appeals court ruling that struck down an Arizona law that banned same-sex marriage, but a Scottsdale attorney is critical of the governor’s comments.
Brewer said in a statement last Friday that she found the ruling is disappointing and troubling. She said it’s not the role of the judiciary to determine whether same-sex marriages should be allowed.
Attorney Pauria Paknejad said the law that Arizona voters passed in 2008 was unconstitutional.
“The Constitution of the United States is the supreme law of the land,” Paknejad said while on KTAR News 92.3 FM’s Arizona’s Morning News Weekend. “If a state passes a law, it has to comport with the mandates of the U.S. Constitution.”
