Arizona group appeals terms for PTSD pot treatment

PHOENIX -- Medical marijuana advocates are appealing conditions set by Arizona health officials for post-traumatic stress sufferers seeking to qualify for treatment.

The Arizona Cannabis Nurses Association filed a notice of appeal this week in Maricopa County Superior Court against the state Department of Health Services.

Health services Director Will Humble said in July that the agency would implement an administrative law judge's decision to allow PTSD patients to get medical marijuana starting Jan. 1.

Humble also said only PTSD patients already undergoing conventional treatment certified by a physician could qualify.

Tucson attorney Ken Sobel argued in court documents that Humble has no authority to add on that requisite and that patients shouldn't have to wait until January.

Health officials said Thursday the appeal had not yet been served to them.
