Arizona ruling upholds use of texts in car accident case

PHOENIX -- The state Court of Appeals has ruled that it was proper that a jury was told about a man sending texts right before a fatal accident in Flagstaff.

The Court of Appeals' ruling Tuesday upheld Salamanca's convictions for manslaughter and other crimes.

Another driver died in a head-on collision when Roberto Alejandro Salamanca lost control of his vehicle after an angry Salamanca texted twice to his girlfriend.

Salamanca sent one text about a minute before someone made a 911 call right after the accident. The appeals court said the jury could conclude that sending that text could have caused the accident.

The other text was sent about a minute earlier. The ruling said that text demonstrated that Salamanca was distracted and angry just before he lost control of his vehicle.
