Prescott stockbroker seeks retrial in murder case
PRESCOTT, Ariz. -- Attorneys for a Prescott stockbroker convicted of killing his ex-wife are seeking a new trial.
A Yavapai County jury convicted Steven DeMocker of first-degree murder and six other charges earlier this month in Carol Kennedy's death. But DeMocker's defense team wrote in a motion filed this week that the evidence didn't support the convictions.
A separate defense motion asked that DeMocker be acquitted.
Prosecutors had no direct evidence tying DeMocker to Kennedy's death, a confession or an eyewitness. But they told jurors that circumstantial evidence was enough to rest blame on DeMocker and that he had a motive in wanting to cash in on Kennedy's insurance policy.
DeMocker is scheduled to be sentenced Nov. 13.
His first trial ended abruptly in late 2010 when his legal team quit.
