US court denies appeal by Arizona death row inmate
PHOENIX -- A federal appeals court on Monday rejected an appeal by an Arizona death row inmate scheduled to be executed Wednesday.
A majority of active judges of the 9th U.S. Circuit Court of Appeals declined to rehear an appeal on behalf of Edward Schad.
Lawyers for Schad wanted a larger panel of judges to consider an appeal already turned down by a three-judge panel.
The appeal argued that Schad received ineffective legal representation during his sentencing.
He faces a death sentence for the 1978 killing of 74-year-old Lorimer ``Leroy'' Grove of Bisbee.
Other appeals filed on behalf of Schad center on the state clemency system and on execution drugs.
Some of the appeals involve another death row inmate, Robert Glen Jones Jr. He is scheduled to be executed Oct. 23.
