PHOENIX -- A supervisory assistant federal public defender is asking some Arizona Board of Executive Clemency members to recuse themselves from the Oct. 2 hearing for death-row inmate Edward Harold Schad Jr.
Kelley J. Henry wrote in a letter Monday that lawyers for Schad believe he ``cannot currently obtain a full and fair clemency hearing.''
The 71-year-old Schad is scheduled to be executed Oct. 9 for the 1978 killing of a Bisbee man.
Schad's scheduled execution last March was postponed when the U.S. Supreme Court denied the state's request to lift a lower court's order blocking the execution. The high court reinstated Schad's death sentence in June.
Schad was convicted of killing 74-year-old Lorimer ``Leroy'' Grove, whose body was found in Yavapai County. He left Bisbee on a trip to Washington state.
