PHOENIX -- The Maricopa County Attorney's Office says it has no political motives in its decision to retry a woman charged with killing her 4-year-old son.

The agency denied such motivations when responding to Debra Milke's bid to disqualify the agency from the case.

Authorities say Milke dressed her son in his favorite outfit and told him he was going to see Santa Claus at a mall in 1989. He was later fatally shot by two men.

Her conviction was reversed by an appeals court that concluded prosecutors hadn't turned over evidence of a history of misconduct by a detective who handled the case.

Milke maintains she's innocent.

Milke contends the Sept. 30 retrial is likely being pursued, in part, for political reasons.

Prosecutors say Milke is being retried to seek justice.
