TEMPE, Ariz. — A man wanted in connection with a fatal Tempe apartment shooting has been arrested in Virginia.

The U.S. Marshals Service said Kyle Levitt was taken into custody Saturday morning in Fairfax County, Va., where was living and working.

The Maricopa County Superior Court issued a warrant for his arrest Thursday following a year-long investigation by Tempe police.

Tempe police say 20-year-old Gabriel Batten died early in April 2012 after being shot at the Haven Luxury Apartments.

They say the victim and a small group of people were at the complex's pool about 2 a.m. when a fight broke out.

Police say Levitt pulled a gun and shot the victim in the abdomen.

It was unclear if the 26-year-old Levitt had an attorney.
