PHOENIX -- A Maricopa County Superior Court judge is considering whether to scale back a Republican-backed lawsuit challenging Arizona's map of congressional districts.

Judge Mark Brain is scheduled to hear arguments on Aug. 13 on the state redistricting commission's request to drop the five individual commissioners as defendants in the suit. It alleges that the commission violated procedural requirements when it drew the map.

The lawsuit seeks to bar repeat use of the congressional districts used in last fall's elections and to require the commission to draw a new map.

The commission says the individual commissioners should be dropped because they individually cannot approve new maps, something only the commission as a group can do.

The plaintiffs contend the commission's motion is an attempt to shield individual commissioners from pretrial fact-finding.
