PHOENIX -- Federal prosecutors asked a judge to dismiss two charges against an Iraqi man accused of detonating a homemade explosive device in November outside a Social Security Administration office building in Casa Grande.

They say the two charges of maliciously damaging federal property by means of explosives against Abdullatif Ali Aldosary should dismissed because a Pinal County grand jury recently indicted Aldosary on arson and related charges for the same conduct.

U.S. Attorney's Office spokesman Cosme Lopez says Aldosary can't be tried for the same conduct in separate criminal courts and that Pinal County authorities will still hold Aldosary accountable.

Pinal County Attorney's Office spokesman Jim Knupp declined to comment.

Federal prosecutors say they will continue to press three gun charges against Aldosary.

Aldosary pleaded not guilty to the federal charges.
