Officer misconduct threatens some Tempe DUI cases

TEMPE, Ariz. -- Dozens of pending DUI cases in Tempe reportedly may be thrown out of court due to an officer's misconduct.

Phoenix TV station KPHO reports that a veteran Tempe policeman who's on a specialized DUI squad now is on administrative leave.

KPHO says the officer remains on leave while an internal affairs investigation continues and that could get his open DUI cases dismissed.

Lawyers say the arresting officer is a key in a DUI investigation and they have to be available, especially if a judge requires it.

Tempe police and the city prosecutor's office say some of the DUI cases have been dismissed without prejudice, meaning they can be refiled in the future depending on the circumstances of each case.
