TEMPE, Ariz. -- Dozens of pending DUI cases in Tempe reportedly may be thrown out of court due to an officer's misconduct.
Phoenix TV station KPHO reported that a veteran Tempe police officer who's on a specialized DUI squad is on administrative leave.
The station said the officer remains on leave while an internal affairs investigation continues and that could get his open DUI cases dismissed.
Lawyers said the arresting officer is a key part of a DUI investigation and has to be available, especially if a judge requires it.
Tempe police and the city prosecutor's office said some of the DUI cases have been dismissed without prejudice, meaning they can be refiled in the future depending on the circumstances of each case.
