PHOENIX -- An Arizona House panel has approved a bill allowing police to destroy medical marijuana seized during a criminal investigation.

Thursday's 5-3 House judiciary committee vote came after a former U.S. attorney for Arizona testified against the changes to the voter-approved medical marijuana law.

Mel McDonald is also a former Maricopa County prosecutor and believes the bill already approved by the Senate undermines the state's voter-approved medical marijuana law. McDonald's son uses medical marijuana to relieve nausea caused by drugs he uses to treat epilepsy.

Sen. Kimberly Yee's bill allows police to dispose of medical marijuana seized during a criminal investigation even if they find it was legally possessed.

The bill requires three-fourths of the Legislature to pass because it changes a voter-enacted law.
