PHOENIX -- A $3 million notice of claim has been filed against the state, Child Protective Services and Glendale police in the case of a missing Arizona girl.

The claim is a precursor to a lawsuit. It alleges that gross negligence by the state, CPS and police led to the "wrongful" death of 5-year-old Jhessye Shockley, whose body has never been found.

ABC15 News reported the claim was filed on behalf of the girl's future estate represented by three family members who helped raise Jhessye for the first four years of her life.

Police believe she was killed and her body put in a Tempe trash bin before her mother reported her missing in October 2011.

Jerice Hunter is awaiting trial on charges of first-degree murder and child abuse.

    They should sue these relatives for not protecting the children from the mother. Sue the mother and father for having her and letting her have kids.

    If they helped raise her then they like any other relative should have been there to protect her. They should not go after $$ from the state, they should look in the mirror first to understand why this tragedy happened. The my child would not do that mentality has to stop. Also the sue thigh neighbor in out society. i.e. Stop blaming others for the mistakes we make or let happen.

    The whole family needs to be incarcerated for stupidity. To seriously try to blame outside entities for the HANDS that killed that baby girl. Ignorant uncaring welfare sucking wh*re of a mother. Absolutely revolting. May many ill wills fall upon this family.

    for the American public. Why take responsibility for something if you can point the finger at someone else and profit off of it at the same time. Ambulance chasing lawyers help to perpetuate this behavior.

    These idiots who think the state is responsible for watching every detail of their lives need to just go away. The mother made some bad decisions and needs to be held accountable for them. If drugs clouded her thought process then she is the one that made the decision to take the drugs. If the family members were responsible for protecting Jhessye then they should share the responsibility and guilt with the mother, not try to cash in by blaming any agency of the state. Freedom without responsibility is anarchy and responsibility without freedom is tyranny.
