Arizona Supreme Court to rule on restitution case
PHOENIX -- The Arizona Supreme Court is to rule Tuesday in a case that could decide whether a person who pleads guilty under a plea agreement can challenge a restitution order that follows.
At issue in the special-action appeal considered by the high court is a restitution award for nearly $41,000 against a man who pleaded guilty to driving under the influence.
The Supreme Court was asked to decide whether a trial judge was legally correct to rule that criminal defendants lose their rights to appeal a restitution award by pleading guilty under a plea agreement.
