TUCSON -- The State Bar of Arizona is being asked to investigate a former Pima County prosecutor for possible ethical violations.

The Arizona Daily Star says Richard Wintory obtained a first-degree murder indictment against a man while working for the county Attorney's Office in May 2010.

The newspaper says when Wintory resigned and moved to the Arizona Attorney General's Office, he took the case with him.

Wintory then announced in August 2010 he would be seeking the death penalty against the suspect accused of paying another man $5,000 to kill a drug associate in March 2000.

Wintory's supervisor removed him from the case last August and said the office was no longer seeking the death penalty.

Wintory is now Pinal County's chief deputy attorney. He says he welcomes the Bar's review.
